October 7, 1850 - The Second Constitutional Convention Convenes in Indianapolis
The original Indiana Constitution of 1816's Article VIII provided that voters should be able to decide if a new constitution was needed every twelve years. The wording of the article led many in the legislature and the courts to believe that the General Assembly could place a provision calling for a new constitution any time they desired. Legislation calling for a new constitution came before the voters various times after 1816, the first in 1820. Voters always rejected these referendums until concern over weaknesses in the 1816 Constitution created the desire for lawmakers to draft a new one. The General Assembly, acting upon the recommendation made by Indiana Governor James Whitcomb, passed an act calling for elections in December 1848. Governor Peter S. Dunning signed the act on January 15, 1849. Voters approved the referendum on August 6, 1849. Over a year later, on October 7, 1850 the constitutional delegates assembled in the Hall of the House of Representatives in the Indiana State Capitol. The proceedings began at 10:00 AM with each of the delegates swearing an oath to the United States Constitution. The Convention met until February 10, 1851, when they concluded their business.
